Who pays stamp duty on a tenancy agreement?

Who pays is decided by the tenancy agreement itself. Where the agreement says nothing, the published default for a tenancy agreement is the tenant. That default is convention, not a statutory assignment of the bill. This page does not tell either party to pay.

What is a diplomatic clause?

On this template, a diplomatic clause is an optional term that lets the tenant end the agreement before the end date after a minimum number of months, by giving written notice. Market convention, not law, is often 12–14 months served and 2 months' notice. Market convention, not law. Both sides can agree something different. The figures on the form are yours to edit.

How long does a landlord have to stamp the agreement?

IRAS's published rule is to stamp a document before signing. The deadline runs from signing, not from the lease start: within 14 days of signing in Singapore, or within 30 days of receiving the document in Singapore when it was signed overseas.

  1. Rent and payment.

    The Tenant will pay rent of S$________ each month, on or before day ________ of the month, by ________. This clause records the rent and how it is paid. It does not set a statutory rate.
  2. Security deposit.

    The Tenant will pay a security deposit of S$________. The Landlord may deduct from the deposit unpaid rent, the cost of repairing damage beyond fair wear and tear, and other sums the Tenant owes under this agreement. What remains is returned to the Tenant after the Tenant has moved out and the keys have been returned. The number of days for that return has not been entered as a verified figure in this template.
  3. Utilities and services.

    Charges for utilities are paid by ________. Internet is paid by ________. Town council or MCST conservancy charges are paid by ________. Each party pays the accounts this clause names for them.
  4. Use of the premises.

    The Tenant will use the premises as a private residence only. The Tenant will not use them for any other purpose without the Landlord's written agreement.
  5. Subletting.

  6. Tenant's obligations.

    The Tenant will pay the rent and the charges this agreement names, keep the premises reasonably clean, not damage them beyond fair wear and tear, and return them at the end of the term with the items on the inventory (if any) in the condition recorded, allowing for fair wear and tear.
  7. Landlord's obligations.

    The Landlord will give the Tenant quiet enjoyment of the premises, keep the structure and the systems the Landlord is responsible for in repair, and pay the charges this agreement names as the Landlord's.
  8. Minor repairs.

    The cap for a minor repair per item per incident is not filled in on this template.
  9. Air-conditioning servicing.

    Air-conditioning at the premises is to be serviced every 3 months. the Tenant pays for that servicing.
  10. Quiet enjoyment.

    The Landlord will not interfere with the Tenant's occupation of the premises as a private residence, except as this agreement allows for access.
  11. Landlord's right of entry.

    The hours of notice the Landlord must give before entering are not filled in on this template, except that in an emergency notice may not be possible.
  12. Termination and breach.

    If a party does not keep the terms of this agreement, the other party may end it by written notice. Ending the agreement does not cancel sums already owed. A statutory notice period or cure period has not been entered as a verified figure in this template.
  13. Holding over.

    If the Tenant stays in the premises after the end date without a new written agreement, the tenancy continues on a periodic basis at the same monthly rent until either party ends it in writing. The length of that notice has not been entered as a verified figure in this template.
  14. Stamp duty.

    Stamp duty may be payable on this agreement. This template names ________ as the party who will pay it, if that field is filled. Who must pay as a matter of law is not decided by this sentence.
